GRADUATION ATTIRE: TERMS OF HIRE
Terms of Hire
All Products are made available for hire on these Terms of Hire only.
We may update these Terms of Hire from time to time at our discretion but any change will only apply to any Products you have not yet paid for.

2.1 In these Terms of Hire, the following words have the following meanings:
Ceremony: the graduation ceremony noted in your Order where we are the authorized supplier;
Graduate: the individual who intends to wear the Products if such individual is not the individual entering into these Terms of Hire;
Order: the order you place for the hire of Products for a particular Ceremony;
Products: the products we hire to you, including gowns, caps, hoods and accessories;
Price: the price for the hire of the Products;
we: Graduation Attire Limited, a company incorporated in England and Wales with registered number 08607640 and main office at King Building, 2 Caxton Road, Bedford, MK41 0LF; and
you: the individual placing an order to hire Products.
2.2 Where appropriate words denoting the singular only shall include the plural and vice versa.
2.3 A reference to a Condition is a reference to a Condition of these Terms of Hire.
3.1 All Products are subject to availability. We will inform you as soon as possible if the Products ordered are not available and we may offer an alternative Product of equal or higher quality and value, or provide a refund for the Price paid.
3.2 We try to display the colours of the Products accurately. However, the actual colours you see will depend on your device and we cannot guarantee that your device's display of any colour will accurately reflect the colour of the Products on delivery.
3.3 You may only order Products from us under these Terms of Hire if you are at least 18 years old and the Graduate wishes to attend a Ceremony where we are the authorised supplier of the Products.
4. Price and Delivery of the Products
4.1 We must receive payment of the whole of the Price of the Products that you order before your Order can be accepted. You authorise us to bill your debit or credit card for the Price any other charges you incur in accordance with these Terms of Hire. Once payment has been received by us we will confirm that your Order has been accepted by sending an email to you at the email address you provide to us. Our acceptance of your Order brings into existence a legally binding contract between you and us on these Terms of Hire.
4.2 You must make sure that all information you provide to us on the Order, including sizes are accurate. If you need to change the details of the Products you have ordered, please notify us as soon as possible, and we will try to accommodate the change, but we cannot promise that we will be able to do so.
4.3 We deliver the Products to you or the Graduate at the location where the Ceremony is held. The hire period is for the day of the Ceremony only unless you have paid to extend your hire, and the Products must be returned to us in accordance with our instructions provided to you, or the Graduate, at or before the Ceremony.
5. Cancellation or Postponement
You may only cancel a contract to hire the Products in accordance with our Refund Policy: (i) if you notify us at least 7 (seven) days before the Ceremony of a cancellation, we will refund you the full price paid; but (ii) if you do not attend the Ceremony, and notify us of that fact within 30 (thirty) days after the Ceremony, we will refund you 50% of the Price paid. We shall refund you using the method you used to pay for the Products and we aim to do so within 3 (three) working days of receipt of your notification.
It is possible that the Ceremony may be postponed. If that happens, we or the relevant educational establishment, shall notify you of the new date for the Ceremony. If you are unable to attend the new date for the Ceremony, you should notify us accordingly either by email or through our online cancellation form, and we shall refund you the Price paid for the Products using the method you used to pay for the Products and within 5 (five) days of the end of the month during which you notified us that you are unable to attend the new date for the Ceremony. However, if you, or the Graduate, subsequently rebook Products for the same Ceremony, we shall charge you the Price, plus a fee to reflect the cancellation and rebooking administrative costs we have incurred.
6. Use of the Products
We confirm that the Products shall be of satisfactory quality, fit for purpose and comply with the description we have provided to you. If this isn’t the case, and the Products are not what you ordered or are damaged or defective, please let us know when you collect them or as soon as you can afterwards, and we will do our best to remedy the issue.
We understand that you wish to enjoy the Ceremony, and that minor spillages and weather related marks may occur. However, you agree that you, and you will ensure that the Graduate, take good care of the Products while in your possession of the possession of the Graduate. Do not attempt to adjust or alter the Products, including by the use of safety pins, or to clean the Product yourself.
If a Product is returned in a damaged or dirty condition that exceeds normal wear and tear, or if the Product is not returned to us in accordance with our instructions, we may you for the full cost of replacing the Product.
7. Our Liability
Save to provide a refund as set out in these Terms of Hire, we shall have no additional liability to you for any failure to deliver Products or any delay in doing so that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, pandemic, epidemic, transport issues, breakdown of systems or network access, flood, fire, explosion or accident.
Furthermore, we shall not be liable for any loss that is not reasonably foreseeable as an obvious consequence of our failure to comply with these Terms of Hire. To the extent permitted by law, our maximum liability to you shall be the Price paid for the Product.
Nothing in these Terms of Hire is intended to limit any rights or remedies that you might have as a consumer under applicable statutory rights, for fraud, death or personal injury or other loss that may not be excluded or limited by English law. For further information about your legal rights, contact your local authority Trading Standards Department or Citizen’s Advice Bureau.
8.1 If you have any complaint or wish to raise a dispute please contact us on firstname.lastname@example.org and not the organizer of the Ceremony.
8.2 If any provision of these Terms of Hire is held by a court of competent jurisdiction to be invalid or unenforceable, then such provision shall be construed, as nearly as possible, to reflect the intentions of the parties and all other provisions shall remain in full force and effect.
8.3 Our failure to exercise or enforce any right or provision of these Terms of Hire shall not constitute a waiver of such right or provision.
8.5 These Terms of Hire shall be governed by and construed in accordance with English law and you agree to submit to the exclusive jurisdiction of the English Courts.
